Awaiting the 112th Congress

Unless you live in a cave, under the ocean, on a distant planet, in a galaxy far, far away, you’ve heard something about the historic change in Congress that resulted from the November 2 election. Republicans gained 64 seats from Democrats, retaking control of the House. That’s the biggest shift since 1948.

What does this sea change mean for IT legislation? Probably not a whole lot. Neither party has shown itself to be particularly effective when it comes to creating a climate in which technological innovation flourishes, math and science education makes significant strides in the public schools, universities graduate more computer and engineering majors, consumers are protected from online fraud, global Internet freedom is championed, and my computer no longer crashes when it tries to run virus scans.

Nevertheless, it appears that the 112th Congress does have its eye on a few IT issues, perhaps the most puzzling of which is Facebook. Yes, that’s right, Facebook. Apparently, Republicans and Democrats in both chambers are very upset that Facebook has been transmitting identifying information to dozens of advertising and Internet tracking companies by way of many of the most popular independently created apps on the site. No one seems to see the irony in a website designed specifically to transmit personal information being castigated for transmitting personal information.

For those Congressmen not overly concerned about who knows they own a Pomeranian and not a Rottweiler, there’s always the issue of cybersecurity. The 111th Congress has done little other than talk about the issue which, considering its approach to cybersecurity, is probably a good thing. We can only hope that the 112th Congress will follow in its footsteps, unless it takes the unprecedented step of actually heeding the advice of experts it calls to testify at hearings concerning cybersecurity legislation.

Other issues that will undoubtedly arise are intellectual property, Net neutrality, technology and business innovation, IT outsourcing, and visas for foreign IT workers and students. How far legislation on these issues will advance through Congress depends only marginally on the nature of the legislation. What is more important in any Congress is who has proposed that legislation and how successful they are at garnering votes. With a Republican House and a Democratic Senate in place, we can sleep well, resting in the assurance that not a lot will be done.
